40 CFR 261.4(a)(24) Verified Recycler Exclusion

The 2015 Definition of Solid Waste Final Rule revised the Transfer-Based Exclusion at 40 CFR 261.4(a)(24) and replaced it with the Verified Recycler Exclusion. Central to this conditional exclusion is that the reclamation facility, and intermediate facility if used, which receives a hazardous secondary material for reclamation must be verified by the EPA or a state that is authorized to do so. Other conditions of this exclusion require the recycling to be "legitimate", to avoid "speculative accumulation", and to keep the hazardous secondary material "contained".
